Terms of sale and research disclaimer
Please read these terms before placing an order. Submitting an order request confirms that you accept them in full.
1. Research use only
All products offered by New Way Labs LLC are chemicals supplied strictly as laboratory reference materials for in-vitro research conducted by qualified professionals. They are not drugs, dietary supplements, foods, cosmetics or medical devices. They are not intended to diagnose, treat, cure or prevent any disease and have not been evaluated by the U.S. Food and Drug Administration or any comparable authority.
2. No human or animal use
Under no circumstances may the materials sold on this site be administered to humans or animals, ingested, injected, inhaled or applied to the body. Purchasers who indicate an intention to use products in this way will have their order refused.
3. Eligibility
By placing an order you represent that you are at least 21 years of age, that you are professionally qualified to handle research chemicals, and that you will comply with all federal, state and local law applicable to their purchase, possession, handling and disposal.
4. No medical advice
Nothing published on this website — including product descriptions, references to published research and answers to frequently asked questions — constitutes medical advice or a recommendation of any kind. Descriptions summarise the scientific literature about a molecule; they are not statements about outcomes in people.
5. Certificates of analysis
Certificates describe the analytical characteristics of a specific lot at the time of testing. They are provided for informational purposes, do not constitute a warranty of fitness for any particular purpose, and do not imply approval or endorsement by any regulatory body.
6. Orders, pricing and payment
Requests submitted through this website are order requests, not completed purchases. Prices are shown in US dollars per vial and may change without notice. An order is only formed once we confirm it in writing and payment has been received in full.
7. Shipping and risk
We ship within the United States. International orders are assessed individually and the buyer is responsible for confirming that importation is lawful at the destination. Risk passes to the buyer on delivery by the carrier.
8. Returns
Because of the nature of the material we cannot accept returns of opened or temperature-exposed product. Material that arrives damaged or outside specification is replaced at no cost when reported with photographic evidence within 48 hours of delivery.
9. Limitation of liability
To the fullest extent permitted by law, New Way Labs LLC is not liable for any loss, injury or damage arising from the misuse of its products, including any use inconsistent with these terms. The buyer assumes full responsibility for safe handling and lawful use.
10. Intellectual property
All text, photography, page design, product descriptions and other material published on this website are the property of New Way Labs LLC and are protected by copyright. Reproducing, republishing or scraping this content for a competing catalogue is not permitted. Compound names, where they are generic scientific designations, are used descriptively and are not claimed as trademarks.
11. Accuracy of information
We work to keep prices, stock status and product information correct, but errors happen. If an item is listed at an incorrect price or is unavailable after an order request is submitted, we will tell you before taking payment and you may cancel at no cost. Certificates of analysis describe the specific lot they name and no other.
12. Governing law
These terms and any dispute arising from them or from a purchase are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules. The exclusive venue for any action shall be the state or federal courts located in Miami-Dade County, Florida, and both parties consent to the personal jurisdiction of those courts.
13. Resolving a dispute
Before starting any formal proceeding, both parties agree to attempt to resolve the matter in good faith by writing to the address in section 20 and allowing thirty days for a response. Most problems — a damaged vial, a delayed shipment, a question about a certificate — are resolved this way in a few days.
14. Indemnification
You agree to indemnify and hold harmless New Way Labs LLC, its officers and its employees from any claim, loss, liability or expense — including reasonable legal fees — arising from your handling, storage, transfer, disposal or misuse of material purchased here, or from any breach of these terms. This includes any claim brought by a third party to whom you transferred the material.
15. Payment disputes and chargebacks
If something is wrong with an order, contact us first — we resolve legitimate problems quickly. Opening a payment dispute without contacting us is treated as a breach of these terms; we reserve the right to recover the disputed amount together with any fees charged to us, and to refuse future orders from that buyer.
16. Export and international orders
We ship across the fifty United States. International requests are reviewed individually and are accepted only where the destination country permits the import of laboratory reference materials. Where an international order is accepted, the buyer is the importer of record and is responsible for customs clearance, duties, taxes and compliance with local law. We do not ship to any jurisdiction under United States trade sanctions.
17. Events outside our control
We are not liable for delay or failure to perform caused by events beyond our reasonable control, including carrier disruption, extreme weather, hurricanes affecting South Florida, labour action, utility or network failure, government action, or the unavailability of a raw material from our supplier. Where such an event delays an order we will tell you and offer either to wait or to cancel for a full refund.
18. Changes to these terms
We may update these terms as our operation or the law changes. The version published on this page at the moment you submit an order request is the version that governs that order. The date of the most recent revision is shown at the foot of this page. Material changes will also be noted on the home page for thirty days.
19. Severability and waiver
If any provision of these terms is found unenforceable, that provision is limited or removed to the minimum extent necessary and the remaining provisions stay in full force. Our failure to enforce a provision on one occasion is not a waiver of the right to enforce it later.
